A reasonable accommodation is a modification or adjustment to a job, work environment, or process that allows an employee with a physical or mental disability to have equal employment opportunities. A reasonable accommodation may include changing job duties, leaves of absence, adjustments to work schedules, relocating/restructuring a work area, providing mechanical or electrical aids, and similar accommodations.
When determining what accommodation is reasonable, an employer is required to engage in a good faith interactive process with the disabled employee. An employer's failure to engage in the interactive process or provide a disabled employee a reasonable accommodation may result in liability to that employee for that failure.
Please contact us to request a consultation if you believe your employer or former employer failed to engage in a good faith interactive process or provide a reasonable accommodation.
